Q&A 6: Are Digital Consent standards globally evolving towards ID side's?

Let's break it out from the outset: Yes, its is. And this is why our strongly de-identified solution is not only a "t time" "must", it is first and foremost a "t+1" first-in-the-Tech-race asset. Let's break it down now, with few observations.

While launching R&D rounds of Research, both in 2019 conceptually and in 2022 to dig into practical implementations, ID side team had to fully assess the global "digital consent" landscape. We observed it was evolving at breakneck speed, and into ID side's direction (last occurence being the adoption by EU Commission of article 88B GDPR in the Omnibus 19 November 2025 draft°.

Here is a gist of ID side CEO observations in the US, India and EU -as she has been invited to share those repeatedly in the academic & Research field (notably to help identifying the new Digital Consent "state of the art" SoP).

US: The "Opt-Out Superhighway" (OOPS)
Traditionally based on Notice-and-choice, the US model is now dominated by state laws like CCPA/CPRA. The default is "yes," but when the user actively searches and clicks "Do Not Sell/Share", it can require to stop "Selling/Further Using" processing cross-platforms. It is an OPT-OUT practical approach, as a "stop sign" on a data highway! Quite basic but humanly manageable.

India: The Centralized "Consent Manager"
In 2023, the DPDPA is gearing up. One of the key innovation stemming from it? A government-backed set of platforms for consent. Imagine a centralized digital dashboard (kicking off Nov 2026) where users can view, grant, and withdraw consent across services in one place. It’s moving the banner outside the website to a national individual-centric framework.

EU: From the Prescriptive "Permission Slip" to automated Privacy signalling
Based on the GDPR (Article 8), EU created a rigorous OPT-IN only world. There is, in theory, no personal data processing without explicit, prior, and granular consent. But in practice: Hello, layered and non-humanly-manageable-cookie banners! In fact, most EU resideents kept granting permissions… first and foremost to access content. So is it real consent or just "by the books" theoretical consent?
For sure, EU institutions flagged it and kept working on it since the "EU Cookie Pledge" work kiched off in 2023. In 2026, article 88b of the omnibus regulation will fast-track EU journey towards a workable digital consent.
