As set in our Privacy Policy, ID side transparently and fairly processes the personal data you provide us with when signing-up and setting your account credentials. This is laid down in our Terms of services and our Privacy Policy, that you officially agree to. You can access more information about such legal ground in our Terms of services and in our Privacy Policy (accessible from the "Menu" or from "My account").

Apart from an email, all fields to fill when you sign-in are optional because they are not strictly necessary to enable you using our service.

Data you provide us with are not shared externally in any way. You are also the only one deciding how recommendations will be served to you, having control on some algorithmic choices.

Internally, admins and maintenance staff will be the only third parties’ agent in capacity to access ID side database. They are submitted to legal obligations entailing they do not consult, check or otherwise use in any way your personal data.

We do not store your personal data outside of EU.

Those Terms of services are drafted to inform you in full details about how ID side will provide its services. Overall, our commitment is to help you identify commercial offers most relevant to you while giving you control over your data and implementing Privacy or Artificial Intelligence (AI) Choices seamlessly. As we stand for a user-centric privacy monitoring, our service remains free for individuals and promotes an alternative to behavioural commercial targeting online. ID side is a tracking-free platform and aims at giving you individual control on data displayed to you but also collected or processed about you.

Our Privacy Policy and Legal mentions respectively set how we process your personal data and provide you with legal information, so that you know what your rights are and how you are enabled to enforce those.

As further explained in our Privacy Policy, the data processing we carry out today is fully in line with the services we propose and that you sign-in for: we strive so that no specific provisions in our Terms of services would be likely to breach any of your reasonable expectations.

As the legal ground we rely on to process your personal data requires so, we fairly ask you to be aware and knowledgeable of “our Terms of services” when you register to ID side. Be assured that we did our best effort to draft it in a legal but also in an intelligible way :).

Legal aspects

This website is available to all, for personal use, free of charge and subject to compliance with the Terms set out below.

By principle, you undertake to access the information provided on our website exclusively for personal and non-commercial use. You may only use ID side website for legitimate purposes and not use it for purposes contrary to Fairness, Public Order and ID siders’ collective & individual rights, interests and reasonable expectations.
When you do access our website (and any content thereof), you agree to be bound by these Terms of services and to comply with any applicable laws and regulations.

After reading, would you disagree to these Terms of services (or some of its provisions), we kindly ask you to refrain proceeding further on our website, signing-in or, if already signed-in, we suggest you contact us to share any specific observation at contact@idside.eu before signing-off. We will do our utmost to quickly come back to you.


Caveats:

1/ By continuing to access ID side Content and use our website & services after we change any provision to our Terms and those become effective, you will be contractually bound by such changes.

2/ For the purpose of these Terms of services, the word “Content” means any written text, software or database, graphic or image, photo or video, podcast or digital material or any other information forming part our website.

Registration to ID side

ID side services are only available if you register. But you do not have to register to access all Content generated on our website. For instance, your Privacy choices might be accessible in a machine-readable way so that anyone interested could access your Privacy, AI, Safety or commercial Choices, whether signed in or not.

If you do register, we ask you to provide only few personal information as described in our Privacy Policy, without which we would not be in capacity to provide our service.

Even if obvious for most of you, we feel the need to remind you that your ID and passwords are confidential, personal and nontransferable and that you are responsible for their management and safekeeping. For security reasons, access to secure sections might be automatically barred after 10 failed access attempts.

General provisions

Your rights under these Terms of services may be exercised as often as you reasonably deem necessary. We would be grateful that you exercise such rights digitally and in writing (using contact@idside.eu).

Any notice or communication in connection with these Terms of services might initially be provided in English. In case of doubt on the meaning of some provisions in other languages (whether such provisions are laid down in these Terms, our Privacy Policy, our Cookies Policy or our Legal mentions), we confirm that, the French or English translations shall prevail (most specific provisions prevailing on most generic ones).

Once again, we insist on the fact that, as a crowdsourced & free service for users, we do not guarantee that our website, or downloads from it, are error-free.

Likewise, no other indirect damage, arising from or associated with the use of our website will hold us liable.

ID side (along with its team of partners and service providers) makes every reasonable effort to ensure that the information provided on our website is accurate and up to date.   • It should not violate or encroach on the rights of others;
  • Specifically, it should not harm others (in particular minors) nor infringe their individual privacy rights;
  • It should not contain viruses, corrupt files, worms, Trojan horses or any other forms of corruptive code or content which may compromise or damage ID side website and Content;
  • It should not include advertising material or unsolicited ("spam") material;

You hereby agree to indemnify all losses, damages, liabilities and costs in connection with any claim arising out of any breach by you of these Terms of services, or claims arising from your use of our website.

From time to time, ID side might invite you to specify your choices.

If you subscribe to notifications’ services provided by us (for instance to be flagged about news relevant to you), if you share comments or otherwise communicate with us through our website or through e-mails provided by us (i.e. contact@idside.eu or dpo@idside.eu), we may further use the contact details (e-mail) you provided to sign-in our services.

By activating such notifications features, you expressly agree that we use & retain your contact information and notify you as per your request but also, only if necessary, for the following reasons: requesting clarifications on your requests or comments or sharing substantial updates (i.e. on our privacy policy).

Scarcely, ID side might send you information on significant updates but will never send massive & irrelevant unsolicited e-mails.

You are entitled to set your Privacy choices & preferences in this regard in your Account.

Links to External Websites

Using our website, you might be put in capacity to access third parties’ websites (such as social networks) to provide increased value to your experience. If we provide links to other websites or resources, you will access it at your sole discretion.

Obviously, we do not monitor or control external websites and we do not endorse or accept any responsibility for their content or operation.

ID side & Privacy

Our Privacy Policy is available on ID side (in your Account and in the Menu).

You understand that your use of ID side services will result in processing your personal data as summarised in our Privacy policy. The Privacy Policy sets out the principles on which we will process your personal data. It is drafted to meet your reasonable expectations.

By using our website, you are deemed to agree with the Terms of such Privacy Policy (that we drafted bearing in mind ID siders’ reasonable expectations -and ready to adjust, based on your contributions). Also, by agreeing to be bound by these Terms and conditions, you also agree to be bound by our Privacy Policy.

Additionally, in performing your obligations under these Terms of services, you commit to comply with applicable data protection laws in your country of residence.

Suspension and termination of our services

On your side

If you stop using our service for up to 12 months, your account will be standing and our team waiting for you to find your way back into ID side’s user-centric privacy monitoring!

Nevertheless, in accordance with the principle of storage limitation, should you not use your ID side account for more than 12 additional months, we may either send you a notification before deleting your registration or delete your account -and any associated information & data.

On our side

We could delete your account at our sole discretion in limited & exceptional cases, that is to say in cases we believe that you have:
  • misused ID side website (or any part of it) in any way;
  • breached any of the Terms specified in this document.

If we have reasonable beliefs on the fact that such misuse or such breach can cause any harm to ID siders community or to anyone, we might suspend or terminate your access to our website, without notice.

Unless you prove that we were wrong doing so, our team will be under no obligation whatsoever to reinstate your registration.

Indemnity

You will keep harmless, defend and indemnify ID side against any claims, losses, costs and liabilities in connection with the use or misuse of our website in breach of those Terms, including any claims by any third party.

Crowdsourced Content & Intellectual Property Rights

For the purpose of these Terms of services, “Intellectual Property Rights” designates:
  • database rights and rights in trademarks, designs, know-how and registered or non-registered confidential information, but also, if applicable, copyright and patents;
  • applications for registration (and the right to apply for registration for any of these rights);

ID side website is fully subject to French law on copyright, trademarks and, in general, on intellectual property.

ID side trademarks & logos on our website -also called “semi-figurative trademarks”- are registered trademarks. By principle, you need a prior express & written authorisation of ID side for any full or partial reproduction or representation, alone or together with other elements.

Intellectual Property Rights in the pages of our website and in our Content belong to ID side, an open & crowdsourced web app. No individual user acquires, by virtue of their contribution or of their use of our site, any rights, title or interest in ID side website.

Our website and its Content are not designed for Users to copy, modify, distribute, transmit, display, publish, perform, reproduce, license, frame or create any derivative works from ID side for commercial purposes (in whole or in part) unless you would be informed and we would fairly carry out (based on consent or any other legal ground) to such additional processing.

Additionally, all Content (text, images, videos, sounds or animations), software, know-how and overall any information displayed on our website, are subject to copyright law (articles L 335-2 of Intellectual Property Code).

Any database appearing on our website is protected by the legal provisions for the protection of databases. In this respect, we expressly prohibit any re-use, reproduction or extraction of elements of such databases and our users might be held liable for any such reuse, reproduction or extraction.

These Terms of services shall be governed by and interpreted in accordance with French law. ID side recognises the jurisdiction of the competent courts of Paris, France.

Local access restrictions

ID side is designed for all internet users. However, we understand that our website (a “.eu” one) might not be directed to or intended for use by any person located in any country. If any local access restriction applies to you, you might not be authorised to access nor use ID side.

Please also note that these Terms of services are based on EU standards requirements and might include legal information specific to one or several countries, such as corporate and contact information, local licensing information or other local disclosure requirements. Aggregated data, statistics & crowdsourcing

Because of the contributions we receive from you, some of which might be incomplete or not entirely correct in a strictly speaking scientific understanding, or include personal opinions that are based on subjective interpretations of information available at a given time, all the aggregated data we share and related statistics might not necessarily reflect the proper views of ID side community.

This is why stats, comments, summaries, storytelling, opinions and any exploitation of data resulting from the use of ID side must be understood as a statement to be reviewed, applying scientific criteria. The liability of ID side cannot be engaged for sharing such crowdsourced contents.

Even if we are under no obligation to inform you about the amendments we carry out regarding those Terms, we will do it in limited but relevant occurrences.

Indeed, from a User point of view, we consider that it is of no added value for you, whether for your interests or for your fundamental rights, to notify you such amendments as far as those are not likely to stand out nor breach any of your reasonable expectations.

Therefore, we may regularly update these Terms complying with the following rules:
  • If such updates are not substantial ones (meaning they are not likely to breach your reasonable expectations or infringe any of your rights), we will not share any pop-up on our website to warn you about such changes, but we will share the date of any last update carried out at the Head of our Terms of services;

Here are our Top 20 Privacy commitments

  1. We consider this Privacy Policy as being much more than a legal compliance tool. We do not "check the box" but actually would like this policy to be in line with both your expectations (see here-below) and our culture (we all sign this Privacy Policy and commit to implement & update it whenever needed).
  2. ID side is designed to help you set your privacy right(s). We will always welcome that you share constructive feedbacks on our data processing. Just share your comments with us.
  3. We commit to review all your inputs and regularly take steps to change the way we process data in order to meet your reasonable expectations. Our team will brainstorm on your inputs at least twice a year. After debriefing, we might change the way we process data & update this privacy policy accordingly.
  4. In case you have a specific legal request, do not hesitate to contact us at any time at dpo@idside.eu. We will come back to you as soon as possible (less than 1 month).

You provide us with your personal data because you want us to help you set, share & enforce your Privacy Choices, but also in order to support, through ID side, a user-centric privacy monitoring online & commercial self-targeting -that is to say the replacement of 24/7 tracking by sharing your intents to buy if you want to. Our Terms of services lay down that we will help you for free, and how we will help.
  6. We rely on these terms to process your personal data and, legally speaking, "the necessity to perform a contract to which you are party" (article 6-1-b) of GDPR). We do our best to summarise such Terms here-below. We invite you, after reading more about it here-below, to share any comment you might have
  7. We are a free service for users, and always will be. ID side will never process your personal data for advertising purposes. If you want advertising online, and set your Privacy Choices accordingly, we will share such Choices with third parties so that they take those into account.
  8. As a crowdsourced web app, we will consult you on your priorities. In case ID siders envisage to get discounts or special offers for their personal data through self-targeting, we will process their data accordingly, but only if you voluntarily fill the appropriate fields to do so (on the dashboard of the Homepage).
  9. Privacy Choices are set to be publicly shared with others (people & Companies) and can be sent using a link, an email, a QR code, a file or ID side’s browser extension (add-on). You also can individually set & share your commercial preferences with Companies monitor & control the way you want to share your Privacy Choices with others .
  10. We aggregate all ID siders' Choices & preferences for real time relevant Statistics. We do so in order to have our reasonable expectations taken into account, collectively.
  11. The personal data we collect from you is strictly relevant to our mission. In case you want to check the full list, please do so. If you have any observation to share, please reach out to us.
  12. We do not collect information about you from other places. We share information with third parties only to provide our services. You have full control on the way they collect information about you when you browse on ID side.
  13. You can monitor ID side notifications here
  14. We keep your personal information until you delete your ID side account. In case you do not use our service for more than 12 months, we will delete it (after checking with you first). No personal data about you will be kept afterwards. Only statistics based on aggregated data including yours will perdure.
  15. We store all your personal data in France.
  16. We carry out risks' assessments so that we identify and mitigate security risks and your data is safe with us.
  17. At all times, you can exercice your rights at dpo@idside.eu, but think first about commenting so that your doubt, reservation or concern becomes useful to all ID siders. Whoever you are, we promote constructive exchanges.

What are Cookies?

Today, ID side collects one by-default: the Session cookie. These Cookies allow you to sign-in and stay logged from one page to another on the concerned website, before you decide to log-off.

This Cookies is a by-default Cookie because it is essential in order to enable you to move around our website and use it. For instance, sticking to the language you pick might depend on such Cookies! Other example: without the session Cookies, you can't log in and be provided with a secured website.

Persistent “log-in” Cookie

ID side offers the possibility to use another functional Cookie, which is not a Cookie "by default" but that our team has retained as useful and potentially appreciated by most of you: a persistent “connection" Cookie -also called" log-in “ Cookie, which (as its name suggests) allows you to stay connected from one session to another. In a nutshell, it avoids logging-in each time you come back to our web app.

When you register, we inform you of the presence of this Cookie. You enable it either validating from the outset that this Cookie should be activated or clicking on the “Remember me” button proposed when you sign-in.

We use Third parties services, such as Vimeo, Matomo or Stripe, to play ID side Motion Design video summarising our mission , to better your browsing experience on ID side based on analytics or to collect donations.
