The EU AI Act entered into force: which impact on individual control?

August 1st, 2024

The EU AI Act requires compliance with additional obligations regarding transparency, data governance, and human oversight. It gives individuals a right to explainability. But does it, in any way, provide additional control to individuals?

The Act has significant implications for digital solutions embedding AI-system-empowered features and requires updates to data protection and privacy programs so that those encompass information on:

  • Compliance with New Regulatory Standards (e.g. transparency, data governance, human oversight, "high-risk" documentation, and mitigation plan)
  • User Empowerment through informed consent and user-centric design
  • Algorithmic Fairness whenever algorithms influence user choices or provide recommendations (those must be explainable and unbiased, requiring refining AI models)
  • Privacy Technologies like differential privacy or anonymization, balancing user data protection with commercial goals
  • Data Sharing and AI Training Restrictions particularly if it includes sensitive or personal data
